Why do I need a Will?

  • A Will describes and outlines how you want to dispose and deal with your property when you pass on. If you want your property to pass to specific individuals you can accomplish that by having a Will.
  • How do you want your property (houses, vehicles, bank accounts, investments) divided to your family or friends when you die?

What happens to my property when I die if I do not have a Will?

  • If a person dies and they do not have a Will they are said to have died, “intestate” or without a Will.
  • If a person dies intestate, Florida Law, outlines who is entitled to inherit the property of a decedent.
  • By not having a Will, a person is letting Florida Law decide who inherits their property.

What is a “Personal Representative”?

  • A Personal Representative is the person or entity designated by you in your Will to be in charge of carrying out your wishes as it pertains to your estate and assets.
  • A Judge is normally requested to grant the request to appoint the Personal Representative who you designate in your Will.
  • Personal Representatives are sometimes also called Executors, Executrix, or Administrators.

Can I “disinherit” someone?
